Terms and Conditions of Sales by Scout Design Studio, LLC


TERMS OF SALE


Returns

Newly-purchased, exclusive Scout-label items may be returned at customer's expense within 15 days, if new and unused, for store credit or a refund minus 25% restocking fee that is contingent on inspection. Floor models, items from online or in-store warehouse sales, custom orders, and vintage items are sold in ‘as-is’ condition with all sales final and no returns. Vintage items will show imperfections consistent with their age, and buyer should assume no restoration work has been performed by Scout unless an agreement has been made for specific refinishing services. Listed pricing for any item purchased online or in the studio does not include shipping, packaging, or refinishing costs unless expressly noted. Sales discounted 25% or more off of regular price are final and not refundable.

Outside conditions beyond the control of Scout can affect the life expectancy of any furniture, and Scout neither assumes nor offers any warranty on Scout-label, vintage, or refinished/reupholstered items after they are retrieved from its studios.

Shipping

Scout will contract shipping through a range of third-party providers, with furniture delivery time to most locations within the contiguous US states of 10-15 business days, but in rare circumstances, up to 4 weeks. It is the buyer’s responsibility to inspect upon delivery, and to refuse receipt of any items not in satisfactory condition. If using a third-party receiver, clients acknowledge the receiving party takes full responsibility for the condition of pieces at the point of delivery if no defects are documented directly with the carrier. On request, customers may also coordinate their own shipping directly with the carrier of their choice by making all arrangements for pick-up and packaging requirements. Carriers arranged by customers take responsibility for item condition at the point of pick-up.

Local Pick-up

Customer pick-ups for all sales must be made at Scout's warehouse location at 1272 Security Dr., Dallas, TX 75247, with the exception of small accessories, as-is vintage pieces, or Howell Street showroom floor models (not returnable). Pick-up hours are Monday-Friday 10am-5pm. Purchased items left at Scout over 10 business days without payment for additional services will be assessed a daily storage fee of $10 per item per day, billable upon pick-up. Items left over 30 calendar days will become the property of Scout Design Studio, with no credits or refunds issued.

Upholstery

For reupholstery, clients acknowledge that yardage quotes are provided to the best of our ability without shorting the piece in question. Due to volume and space constraints, Scout will not be responsible for the handling and return of excess client fabric. Deposits made for any work are not refundable if an order is cancelled. If an order is cancelled before shipment, that deposit or payment will be returned to the customer as a store credit which can be used for future purchases at Scout Design Studio.

All sales are subject to acceptance by SCOUT DESIGN STUDIO (SCOUT)

GENERAL


This website is owned wholly by Scout Design Studio LLC. Throughout the site, the terms ‘we’, ‘us’ and ‘our’ refer to Scout Design Studio. Please read the below terms that are used to govern our site. If you do not agree with the terms, do not use this site in any way. Additionally, Scout Design Studio reserves the right to modify these terms at any time without prior notification. Site users must agree up and abide by these changes accordingly. For most up to date terms and conditions, please review this section of our website frequently.

All content on this website including photos are the property of Scout Design Studio. The contents of this website is intended for non-commercial use by the users or our site.

ENTIRE AGREEMENT


Acceptances of sales is based on the express condition that Buyer agrees to all of the terms and conditions contained herein and also in the material and price lists provided to Buyer relation to Scout products. These terms and conditions represent the complete agreement of the parties, and no terms or conditions in any way adding to, modifying or otherwise changing the provisions stated herein shall be binding upon Scout unless made in writing and signed and approved by an authorized representative of Scout. No modification of any of these terms will be affected by Scout’s shipment of goods following receipt of Buyer’s purchase order, shipping request or similar forms containing printed terms and conditions conflicting or inconsistent with the terms herein.

PRICES AND TERMS


Orders for all products require payment in full. All accounts shall be paid upon receipt when invoiced. Orders must be paid in full, including STORAGE, taxes, freight, shipping charges and service charges prior to shipping. Checks are to be made out to Scout Design Studio. Credit cards accepted American Express, MasterCard, Discover & Visa and are subject to a credit card fee of 3%.

TAXES


All taxes of any nature whatsoever now or hereafter levied by governmental authority, whether federal, state or local, both directly or indirectly, upon the sale or transportation of any goods covered hereby shall be paid and borne by Buyer if a resale tax certificate is NOT provided. A Texas sales tax resale certificate form will be provided and must be filled out and returned to process any sale or antique transaction of SCOUT DESIGN STUDIO.

SEVERABILITY


In the event that any one or more of these terms or conditions is held invalid, illegal or unenforceable, such provision or provisions shall be severed and the remaining terms and conditions shall remain binding and effective.

PRODUCTS


The products featured on www.scoutsdesignstudio.com have been represented to the best of our ability through photography, dimensions and any other descriptions that have been provided.

UPHOLSTERY


Buyers are allowed to provide COM fabric.

Yardage and square feet listed for upholstery includes self-welt.
Welt yardage amount is required only when welt is contrasting.
Trim or cording yardage available upon request.

USER SUBMISSIONS


Scout Design Studio prides itself on creating an interactive environment through the website and all other Social Media. User comments through the website or social media pages maintained by Scout Design Studio will become the property of Scout Design Studio. If an image or comment is posted through any social media website, including any image accompanied by a hashtag, referencing Scout Design Studio or any of its sister companies, you are hereby granting access to Scout Design Studio a worldwide, royalty-free, fully paid, non-exclusive, perpetual, irrevocable, transferable and fully license without additional consideration to you or any third party, to store, reproduce, distribute, perform, and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use and exploit such photos, in any format or media now known or hereafter developed, in connection with Scout Design Studio’s business.

INDEMNITY


By using this site, you agree to indemnify and hold Scout Design Studio (and it’s employees, partners and owners) harmless of any claim or demand, as well as losses, expenses, damages and costs, resulting from any violation of these terms of service of any activity related to your account (including negligent or wrongful conduct).

Scout Design Studio cannot be assumed as liable to you, the customer, for any direct, indirect, incidental, special, consequential or exemplary damages that result from the use of, or the inability use, the materials and services on this site or the performance of any of its products.
